I got into an accident on a rainy day. I did not hold collision or comprehensive. Because I skidded into a ditch and the car rolled, an oil leak occurred. The fire department came and had to put oil dry on the oil leak which was saturating the ground. I hold all the other coverages (liability/property damage, underinsured/uninsured motorist/medical). The fire department bill for the oil leak clean up / hazard removal was $500. The car insurance company says it falls under collision and since I don't have it they don't have to pay out the $500. I insisted it was under liability / property damage as the oil leak is a hazard and causes property damage. Is this fair that they said it falls under collision? Or should I fight it. If so how?

Hi. On April first, my neighbor hit my dad's car in our neighborhood. Our garages are facing each other, and my dad was going backwards to get out of our garage. She didn't stay in that position, she moved and my dad did the same. The white bumper of her van had no visible damages, but my door needs to be replaced. Also, there is white paint in car in the place she hit it. We asked for her insurance, but she didn't have it in that moment. We wrote the plate number and took some quick pictures. I called my insurance to report the accident. In the night, when she returned home, we asked for her insurance, but she refused. We called the police and she agreed to give us her insurance information. In fact, she wrote the information herself. I called her insurance(Geico) the next day, and she had already made a claim, and she only said she didn't hit my car; she didn't give more details. My dad gave his version of the accident with a lot of details, but she didn't do it. Her Insurance tried to contact her, but there is no answer from her. I see her everyday, so I am sure is not responding on purpose. Now, her insurance called me and told me that because she is not responding, there is no way to confirm she was involved in the accident. therefore, they denied liability. I was shocked because they took that decision only because they cannot contact her. They didn't came to take pictures of the place or the cars. So, I tell them I was going to send the pictures I took. I did send the pictures but now, the adjuster is not in his office, and he will be back next week on Thursday. It makes no sense as a lot of people have licenses for ID only and do not have a car (because they aren't allowed or can't drive): By law if you have a driver's license you are supposed to carry insurance whether you own a vehicle or not. It's usually called non-owner's liability coverage. Because of this law they would be able to suspend your license if your company cannot provide proof that you have coverage. Our 1990 GMC truck (average condition -- nothing special!) was vandalized about two months ago. The punks damaged the doors so badly trying to get in that our insurance co. was going to write it off. NOW we got a letter from AB Transport saying that the truck is salvage, and no longer legal to drive. Insurance wrote it off! The cash is gone (spent very wisely -- don't judge!), and now we are being forced to buy a new truck. Insurance told Hubby that we didn't have a choice , but I thinks that's bogus. Hubby signed papers for the cash settlement, but nothing for the write off. CAN THEY DO THAT? What are our rights?

My Dad takes care of our family car insurance policy with Mercury. Recently, they have asked about an incident which matches the date of a hit-and-run which I reported to police. They refused to pull over or get out of their car, and sped off soon after, so I reported it to the police. Now, Mercury wants to talk to me about it. Insurance totalling my car looks suspicious?

At this point I regret making a claim and wish i could turn back the clock. I am being forced into a box and it looks shady. Three weeks ago my 2005 Cadillac STS was involved in a parking lot flood where the water rose and filled the floors of my car by about 4 inches. All us neighbors had cleaning parties using a wet vac and baking and toweling are cars in the sun over the next few days letting our vehicles dry out. On my car everything works like a dream as it did before with the exception of a 'check stability control' notice that comes on when I start the car. I have been driving the car fine since the flood and decided maybe I should make a claim to fix this error that pops up on the dash when i start the car. From the time I dropped it off at the dealer it has been all negative. Right away the dealer was negative and telling me it's the end of the world with my car, everything is ruined and it will probably be a total loss. He got the adjuster for my insurance company out there and it looks like it will be put in to the total loss category. No i am just asking the insurance company to forget everything and drop the claim because the damage is not that extreme and i dont want to lose my car. I am told at this point it is too late. Is that true? My neighbors are floored by this, i have been driving it around for a few weeks just fine and the car still looks new With only 62000 miles on it. I can't help from thinking that something suspicious is going on here. Do they stand to make a nice profit by totalling my vehicle and then replacing one module for a 1000 or so and having a perfect car with all systems working? Also the lady from the claims office said the car had to be 80% damaged for it to be a total loss. I asked her if this was based on speculative problems that they think may occur in the future because of the water, or based on actual damage now? She said it had to be actual damage now but couldn't give me any details from the adjuster yet. Can I demand that the adjuster list everything that he thinks has been damaged to my car (which I am convinced he will have to be creative to do so)? The car as i said drives wonderful, I checked the fluids on my own (fine), and the car looks new. Do I have any recourse here? I just want the car fixed for the one problem, i dont want to lose the car, and at this point I don't even care about having insurance fix the one problem, but again I am told it is too late to go backwards and drop this entire issue. I almost have an inclination to report this because it looks so shady. No reasonable person would look at, and drive this car and consider it a total loss. What is the agenda of the insurance company and cadillac dealer here? Something smells foul with this situation.

I hit a car in Alaska, no damage to the cars except a tiny tiny dent on the other car's back bumper that barely can be visible within 20 inches distance if a person keeps looking very good. I gave all my details to the other guy and I am legal in everything. he showed me an insurance on his phone that expired on May 2012. Because I did not pay attention, right now I just found out from the VIN # that the insurance is for a different car but in his name. So I am not sure if the car I hit was insured or not. Cancer survivor getting health insurance or life insurance.?

I'm a childhood bone cancer survivor. I had osteosarcoma back in 1992 and had my leg amputated but the cancer never returned and the only issue after is I can't donate blood. I feel good and bad about this law. I'm conservative. I don't entirely agree with the law. But it's good that people are able to get on an affordable insurance plan if they have a pre-existing condition rather than being left out to die. But what about the people who are getting kicked off insurance plans and now have to pay even higher rates than they already were? I get a subsidy for my plan. I don't feel like I deserve it. What happens if you rent a car and decline any coverage? I was told that if you were involed in an accident you would have to make a claim with your own insurance company. What if you don't own a car and thus don't have an insurance company? Are there limits to the amount of responsibility of the renter? I am a teen mom and since the baby can't be covered under my parents insurance we are planning to do a legal guardianship, however you cannot get guardianship of an unborn child so we are doing it after he is born. But I was wondering if right after he is born if the hospital bills will be under my parents insurance because I have heard there is a 30 day period in which you need to get the baby's insurance arranged. While he's doing this i horn my horn he looks back and completes his turn and the brakes and doesn't move... i'm down shifting and my rear wheel locks up when i downshifted my bike shakes and i going onto the curb my bike gets eating up from the curb and i go over the curb and start to eat **** my hip and left get bruised i was wearing this thick overcoat my arm gets road-rash and then the old *** man drives off... doesn't even assist me... my brothers flip a U and we pull my bike to the side of the road and go to the hospital at the hospital we called the police they took pictures of my motorcycle and skid marks on the road then take my statement and brothers i wanted to know can i sue my insurance for anything? My bf and I have been intimate for the past almost 3 years, which is how long we've been together, we've only used protection a few times. I did this stupid offer on the web about some car insurance quotes and I didnt think that anybody would call me or anything but I was wrong. I was in an accident last month in my brand new Volvo (not even a month old!). I was rear-ended, while I was at a stop sign. Damage is to the rear bumper, pretty bad, looks horrible...especially for a new car! No one was hurt, just shaken! We did not immediately file a police report. We exchanged information, and the the person who hit me told me that they would pay for my repairs out of pocket, and that they didn't want to get the police or insurance involved. We conversed on the phone for a few days, and they seemed like everything was going great, and I was supposed to meet them at their friends auto body shop for the repairs...long story short...they never showed. Bad part now is, I never got their insurance information, just license plate, DL, addresses(basically everything BUT insurance). That same day, I went to the police station and filed a delayed police report. Later that week, I went and got 3 different estimates, and the damage averages out to about $900. I contacted a friend of mine, who is a police officer, and they stated that I can issue a summons to the person who hit me for careless driving, and I will have to go to court. This is basically to show them that I'm not messing around. All I want is my BRAND NEW car fixed!!! I'm NOT going through my insurance because my deductible is $1,000, and the damage is less...not only that...it wasn't my fault! My insurance company advised me to have person who hit me's insurance take care of everything, at no cost to me. Here's what I need to find out...Can I send the person a demand letter, basically stating that I want them to have their insurance take care of everything? I have tried to call them, and they send me to voice mail, so reasoning is not an option any more. I don't really know how to go about this?! I want to try this on my own, and not get an attorney involved. I just want to tell them that if they fix my car, I will drop summons and further proceedings (like small-claims court, which I WILL sue for additional $$ for dealing with all this). But, what if they don't have the money? I have no idea what to do. I live in NJ, hope someone can help!

I am not sure how much home insurance coverage I should have for the house I bought 2 years ago. The cost of the house including the land was $96,000. But that includes the price of the land, etc. I now have to renew the home insurance policy and realized maybe I should reduce the amount of the coverage from $96,000 to around $80,000. The dwelling amount for the insurance has been the price I paid for, $96,000. But if something happens and the house needs to get rebuild, the cost of building should not be as high as $96,000. Question on best company for classic/historic car insurance?

Our family has had State Farm for 70 years now, several generations, and in the last 10 years or so we have been progressively more & more disappointed in their caring and customer service. Maybe its just the 'assistants' that my local SF agent (who never talks to his clients any more) use, they both seem to have just horrible attitutudes, sarcastic, and act like you are a complete PITA every time you call. I even have an email from his main assistant that I asked her to forward to the actual agent because I was told he was the only one that could answer my question, and just today I was SHOCKED when I re-read the email, and saw in the forward of my email when his assistant sent it on to the actual SF agent, She said This guy will just not give up, he keeps haunting me about this issue! I couldn't freaking believe it. I was going to forward the email to SF headquarters in Bloomington IL, but then as I read more & more about state farm I saw they are completely independent agents in each office, and have literally NO ONE who is their boss or who can reprimand or correct them. This is unbelievable. If I treated my customers at my work place & gave them the rotten attitude treatment we get from our SF office here, I guarantee you I would lose my job. No one is in charge at state farm obviously. Back to my question - I recently bought a classic car I have been looking for a long time - getting it next week - it is 25 yrs old, all original & in perfect shape. My state (Maryland) lets me register the car as Historic if it is 20 yrs old or more. I plan to do this. I contacted my wonderful state farm office today, to get a quote on a new policy/binder for this collectors car. They apparently don't like insuring a vehicle as Historic, maybe the policy is too cheap & they do not make any money off it. The 'assistant' said the best they can do, even if I REGISTER this vehicle in Maryland as Historic & get an Historic tag, which I will do, she said the best she can do is insure it as part time, occasional pleasure use, under 7500 miles a year . Which of course is NOT an historic policy. You can get that on ANY extra car you have in your household even if it is a 2011 model !! She did say (and I understand this being required) that in order to have is classified as Antique/Classic/Historic, you have to have an appraisal done on the vehicle as if it just came off the show room floor -then the premiums would be much lower if you had full coverage on it, as historic/classic . So here we stand. Can someone out there please help me understand - am I being taken for a ride by my State Farm office? Should I shop around for insurance companies that just specialize in Classic/Historic auto insurance? If so can anyone recommend the best companies that specialize in reasonable insurance for classic/historic vehicles? Thanks for your help. .

So as a 16 year old male driver, I'm aware that car insurance rates for me are significantly higher than a same age female driver, just because of my gender. How are insurance companies able to do this, no matter how many statistics they have saying we crash more, speed more often, ect...? This is discrimination vs. my gender, and for all they know I could drive like a granny. Now consider this: if statistics showed that blacks were twice as likely to crash than whites, could insurance companies charge more? No way! The NAACP would be all over them. That would be unfair to the black drivers that may drive safe. I just dont get why I am charged way more than what a girl gets charged, even though I am a very safe driver.

I was heading down a hill; the road was icy. The truck wasn't stopping properly. It slid into a curb; damaged the wheel (rim). Now, the truck swirves to the left when I drive. We will need to make decisions based upon retirement income and expenses. I have done some preliminary research and it appears I need to do a lot more. Although I have spreadsheet skills, I can visualize that any template I make must provide for more assumptions than I want to make. HELP! Insurance company trying to low ball estimate?

Back in April I was driving and a lady tried switching lanes and struck my vehicle. I immediately went to an auto body shop and got an estimate for the damage, they took photos and everything. I've been contacting her insurance and dealing with this for over two months... I had to send them the police report because the woman tried lying and said I hit her, so I had to prove she was at fault. They would never return my calls. Until I talked to the field adjuster. He then called me yesterday told me he got the estimate from the body shop which was one of their recommended shops, and was mailing me the check for the damage. However he failed to tell me the check he was sending was for $1000 less than the estimate. I don't agree with this, what do I do? I called and no one will call me back from the company Also, I own my car outright. It's a 2004 tiburon is excellent condition. The insurance company was giving me issues about me wanting the check sent to me. I plan on getting the damages repaired that are necessary but leaving what isn't and keeping the money that's left over. I'm not even making them get me a rental for the time I don't have the car! About 3-4 months ago I was parked in a supermarket car park. My mum, opened the passenger door where the wind blew and hit the car next to us. Upon packing the car, the passenger in the alleged 'chip' car stated that their car was damaged- the damage was barely even visible- something you would expect as a driver to occur. I even questioned whether that 'damage' was the fault of ours because the car was that battered. Anyway, 3 months later I received a letter stating that I was involved in an accident on the 21st of June. This date is also incorrect where this 'accident' actually happened on the 1st May (my car insurance renewal date). My insurance know this happened in this time as I called them to ask what may occur. Could anyone provide me with details of when it is the latest time to make a claim. Also, what would usually happen for the 'chip' in question since I know this day that it allegedly happened was a lie. (UK answers only please)

Two years ago, I was sitting in a parking space waiting for my friend. He pulled in on the left side, and his right front fender crashed into my rear left quarter panel, causing some ugly damage. Long story short, I didn't get his insurance information. He said he would give it to me later. It has been two years, and the past few weeks I've really gotten on his case to get the information or for him to fix the damage. It has been excuse after excuse, and he now wont answer phone calls. I can get his license number, name and address, so I'm wondering if I need to call my insurance company or the police to get this fixed. I don't need friends like this but I'm wondering if the statute of limitations in california has run out, or if I won't have any luck calling the police. I just want the car fixed, and the damage is estimated at 500 dollars. Any ideas?

Drunk driver ran into fence of ours and his insurance wont cover full cost to replace...what can we do?

recently, an underage drunk driver ran his car off the road and into our fence and tore up about 100 feet or so. we had a company come give us an estimate of around $1000 to fix which includes material and labor...the insurance company of the young man that ran into our fence is only willing to pay around $600 because they are saying that the fence is 15 - 20 years old and didnt cost that much back when it was built.....now, i have a huge problem with this...is it our fault that a drunk driver ruined our fence...should we have to pay out of our hard earned money the rest to make sure the fence is put back? is there anything we can do about this? any feedback is helpful....im so mad i want this to get nationally recognized!

The offer that my insurance company is making is much lower than NADA and Kelley Blue Book values--the insurance company is offering 9,200 and the NADA value is 11,600 (KBB is 12,500). They said that their estimate was based on the local market value and was an average of private party and dealer values. They looked within a 100-mile radius and found similar cars. They then adjusted the value to reflect the mileage of my car, but I don't know how exactly they calculated this adjusted value. I bought my car from a dealership seven months ago--shouldn't the replacement value be the retail value? Also, I had a Subaru WRX and they compared it to WRXs and to Impreza Outback Sports. I looked on autotrader.com and on other Internet resources and found WRXs that were listed much higher than the WRXs in their market report, and I don't know what to do--I don't want to spend the money for a lawyer, but I feel as if I am fighting a losing battle.

Well I've been looking into getting a camaro but insurance may be too much. I just have a few simple questions for anyone who knows. Does the insurance company charge more for an Iroc / Z28? Would they know if you bought a camaro with a (for ex.) 377 stroker and charge more? recently suffered total loss due to fire of my car and claimed on my insurance policy they came and valued the car after the accident and then took 300 quid off for policy excess however it clearly states in their policy that they cover permanently fitted radio/audio equipment to max of 500 euro , fair enough so i submitted my claim to cover the radio which was destroyed with the car as a result of fire , cost of cd/radio was 149.00 in argos but company now say that their definition of permanently fitted radio is one that has been fitted in the factory when car was made but my car is secondhand and had a sony cd/radio fitted when i bought the car . Now they say this is not covered as is not classed as permanently fitted , to me a permanently fitted radio is one that you cannot take out of the car unless you are replacing it , some cd/mp3 players are easily removed for security and can be taken from the car each evening but this is not the case with mine Anyone else out there been taken for a ride by their insurance company , was thinking of legal action as they should have specified factory fitted radio in their advertising instead of permanently fitted Had arguement with them for 30 mins but they kept saying that the radio/audio had to be factory fitted from new
